1. About these terms

These terms cover your use of the Promo on Demand website, operated by Engaged Nation, LLC ("we", "us"): the home page, the Resource Center, the Game Library, the Pro Football Pick 'Em sandbox and the website's forms. By using the website, you agree to them.

They don't cover the Promo on Demand platform itself, which our customers use under their organization's agreement with us, or taking part in a campaign, which is governed by that campaign's own rules. You can read our standard campaign privacy policy and rules. How we handle information collected through the website is described in our Website Privacy Policy.

2. Using the website

You may use the website for lawful purposes. You must not:

• try to get into any part of the website, or any system behind it, that you're not authorized to use;
• interfere with the website or place an excessive load on it, including by copying it with bots, scrapers or other automated tools; or
• send false information or spam through its forms.

3. Our content

The website and everything on it, including its text, documentation, images, games, videos and software, belong to Engaged Nation or the companies that license them to us, and are protected by intellectual property laws. The Engaged Nation and Promo on Demand names and logos are ours. You may view and print pages for your own information.

The creative assets in the Resource Center are provided for our customers to promote their own Promo on Demand campaigns. Any other use of the website's content needs our written permission.

4. Demos and the sandbox

The demo games, the Game Library and the Pro Football Pick 'Em sandbox show how Promo on Demand works. They award no prizes, and nothing you do in them counts toward any campaign.

5. Information on the website

We try to keep the website accurate and up to date, but features, games and other details can change. The website is for general information. It isn't an offer, and it isn't part of any agreement with us unless that agreement says so.

6. Other websites

The website links to websites and services run by others. We don't control them and aren't responsible for their content or their privacy practices.

7. No warranty

The website is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties about it, express or implied, including that it will be uninterrupted, error-free or free of harmful components.

8. Limitation of liability

To the fullest extent the law allows, Engaged Nation, LLC and its officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the website, even if advised of the possibility of such damages.

9. Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles. Any dispute about them or the website will be resolved exclusively in the courts of Clark County, Nevada.

10. Changes to these terms

We may change these terms. We'll post the new version here and update the effective date at the top, and the new terms apply from then on.
